LAPD May Have Erred in Ellen Dog Case

226. I have never in any previous post, nor will I now argue the validity of the "no rehousing" clause in a pet adoption contract. Personally, I would never adopt an animal into my home with such conditions. That is my choice. Others may not mind this clause and may choose to accept it, that is their choice. My only advice is to read pet adoption contract or any other contract for that matter carefully and ask questions before you sign. I would also advise anyone who wishes to adopt a pet to find out what the requirements are for the adoption and review the adoption contract BEFORE even looking at the animals.

227. The only defense that anyone has made concerning the absolute indefensible actions of Paw Boutique concerns the "no rehousing" clause. That may have been in the contract and that contract may have even been broken. If that is the case, why did they not seek a judgement for the animal? Is it because they did not have the resources to seek a judgement? No, because their time and legal expenses could be recovered as additional damages.

228. My concern was that this looked to me, on the video, like an illegal search and seizure. Also, by the way that Baktis was doing that eloquent, "keep away" dance, it seemed as though it were very practiced and may have been done before. Even if the contract is valid, it is not ok for the rescue to show up and take the dog back without going through proper judicial procedures.
PS, at least here in Philly, it looks like a beautiful day! I, for one, am going to take my pups out and enjoy it for awhile.

229. The Mutts and Moms people should be charged with a criminal offense of stealing a dog and entering a house under false pretense for the purpose of stealing. They did not have a license to operate as a rescue group and therefore the contract Ellen signed is not valid. Therefore they had no contract with Ellen and Ellen could do what ever she wanted with the dog. Ellen and the hair dresser should file a police report for the dog that was stolen from them and give the video tape of the woman stealing the dog to police. Now she can give the dog back or go to jail for theft.

230. This entire event has shed some light on things for me. I have adopted dogs from local shelters, but have not adopted any from a 'rescue'. I was thinking about it though. I have seen such sweet doggies online, and I know they would have a good home here. After reading these posts, though, I think I will forget it. According to so many rescues, they always keep their name on the dogs microchip, and always have a vested interest in the dog. So for the entire life of the dog, you are only renting it. What if I die? Do they get to come in and decide the fate of MY dog, whether I have provisions or not? At what point does their involvement end? No thanks. I will continue to support the local shelters, but my dog is MINE.

231. Ridiculouzz- Yeah, basically that's it. You are renting the dog for as long as you don't violate the contract. The ASPCA is a pretty ordinary, run of the mill place and if they have a no rehousing clause, you know that must be standard. I also think the Philly ASPCA does a heck of a job of saving the lives of unwanted animals.

233. Geez. AlecsMom, we get it, Ellen set up a few animals with good homes and therefore should be shot. You also keep harping on the no rehousing rule and the fact that "everyone's doing it". Nobody is attacking the no rehousing rule.

What has people in arms is the fact that Paw Boutique, through it's cheap advertising gimmick and tax-dodge, Mutts and Moms, entered a person's home under false pretenses with the intent to steal from them. A few people are also somewhat annoyed that they perverted the pet identification microchip to fool the police into being their accomplice.

Defending them and telling people that their actions are accepted and condoned by the animal rescue community at large is placing countless animals at risk because Paw Boutique's actions are considered reprehensible by most folks and if they think that they will experience similar if they go to a legitimate rescue group, they won't deal with them, and as a result pets will not get homes and be slaughtered.

For someone who loves animals you are trying to kill a s_it load of them. Speaking of, exactly how many animals have you adopted and over what time span? Just curious.

Dear Ling,
Why are you so judgemental about an entire country and use one womans personal wishes as an example? The American people have always stood up and supported people less fortunate than themselves in emergencies. I have travelled the world, and there is not any country or race I have encountered that does more for others in need as this country. Do you plan to leave your assets what you have earned over a lifetime to a famiy member or friend? or do you plan to give everything you have to someone in another country that you do not know? You are obviously able to get on the internet and type in a second language so I assume you are not doing badly for yourself. What do you do to make the world better?

It is disgusting that anyone can condone eating a dog or cat in any country, that is not even an argument worth pursueing. In your opinion why should Ellen go to jail? She did not break any laws, she broke a contract. In this country we do not throw people in jail for breaking contracts. At least not until after they are given a trial. We do however, throw people in jail who break the law. Animals are personal property, and once the are sold, given or traded to another party they become property. By going in under false pretenses to take the animal, Moms and Mutts they broke the law... so why should they not be going to jail in your ever so wise opinion?

Who are Ellens victims that you speak of? The only one I am aware of who is really a victim of all this stupidity is a dog....And according to you it is ok to eat dogs(?????)
Why would it make sense to send Ellen to jail????? Why do you care so much about a story of one woman in another country and her mistake with the dog??? If this is what you need to make the world make sense to you, please please please get some help. There are vastly bigger problems in the world

236. The Philly Spca does not have a rehoming clause in their contract. However, when I checked out most of the rescues on petfinder.org - they do have rehoming clauses. So, for me at least, I will not deal with any of them. My experiences with Philly Spca have been mostly positive so far. I also think they do a really great job with the animals they place. I notice that they seem to be very good in assessing a dog's personality. Whenever I go there almost all of the people who work there are very personable and willing to help you in any way possible. I will continue to support them, and maybe even adopt from them again(and again -LOL - depending on how many dogs I really CAN handle : )

237. Your comments: A agree with you Rediculouzz, not dealing with a lot of these rescues that have that no rehousing clause makes sense. I will not accept some stranger's permanent intrusinon into my life. Also, their animals are already safe. It is better to go to the "pound" where animals are dying and get one from there. If these animal rescue groups are actually in the "business" because they want to save animal's lives, they would agree with me.

238. Luca-- Your comment about the smell, just cracked me up! Thank you! It does seem as though whenever anyone of them say anything about Ellen, it is against her character. I did not hear Ellen say anything against this woman's character. From what I gathered, this woman feels that she has to match each dog exactly with their adopter, and then she has to follow up regularly to make sure the people are doing exactly as she wants with the dog. Maybe this works for some people, but I sure wouldn't like it. It's like puppycam, let me spy on you to make sure you are complying with my wishes. That is way too controlling. Somehow, I think she really feels that she is helping these dogs, and she prob is in some ways. But in this instance, it seems she really went overboard on the control issue. Imagine all of this publicity being positive for her, had she known how to handle this situation correctly. Before flying off like she did, she should have gotten some help on how to deal with this problem. I think that she has been able to be high handed with other people, so she just figured she could do it again. Eventually, whether it was Ellen, or someone else, she was going to step on the wrong toes the wrong way, and this outcome could have been much worse. Thank God that she was not hurt physically and that the rescue dogs she has were not hurt either. I do not agree with her, but I would not want to see her physically hurt. And people are crazy sometimes. You cross the wrong person, and they will put a hurtin on you. I think Ellen probably feels horrid that this has gotten so out of hand. No one could have anticipated this being so wild. I also thought that I read somewhere that the "Fink' attorney, was not representing Baktis legally, just as a spokesperson.

239. Has anyone seen or heard any of these "death threats" that Paw Boutique received? I heard some people wishing them ill on one entertainment show or the other but I haven't seen or heard anything that I could consider an actual threat. Could someone please let me know where I can review these "threats" to Paw Boutique and M&M or is this just another misrepresentation of the truth by these grifters?
